Hospital Privileges Appeal Board

The Hospital Privileges Appeal Board (HPAB) is an adjudicative agency that hears appeals from members or former members of the medical staff (staff member) of an approved hospital who consider themselves aggrieved by a decision of a board of an approved hospital (hospital board). The HPAB consists of up to 7 members appointed by the Minister of Health.

The HPAB functions independent of government departments to ensure fairness and impartiality when hearing appeals as set out in the Act.

Making an appeal to the Hospital Privileges Appeal Board

The HPAB hears appeals from staff members of an approved hospital who feel personally aggrieved by a decision made by the hospital board. The types of decisions are:

  1. not to reappoint the staff member as a member of the medical staff,
  2. to reappoint the staff member with different hospital privileges than those the staff member had immediately prior to the reappointment,
  3. terminating or suspending the staff memberís appointment as a member of the medical staff,
  4. terminating or suspending the staff memberís hospital privileges, and
  5. varying the staff memberís hospital privileges.

Any staff member of an approved hospital who feels personally aggrieved by a decision made by the hospital board can appeal.

The staff member can appeal the decision by the hospital board by giving written notice of appeal to the HPAB within 90 days after receiving notice of the hospital boardís decision.

HPAB and its decisions

The HPAB follows the Rules Governing Hearing of Appeals for pre-hearing and hearing procedures of appeals. On hearing an appeal, the HPAB may:

  • confirm the decision of the hospital board,
  • direct that the former staff member be reappointed to the medical staff or that the staff memberís hospital privileges on reappointment be varied,
  • direct the reinstatement of the former staff memberís appointment as a member of the medical staff or of the staff memberís hospital privileges,
  • remove or vary a suspension, or
  • direct that the staff memberís hospital privileges be varied.

About the HPAB

The HPAB consists of up to 7 members appointed by the Minister of Health, each for a term of not more than 3 years:

  • 2 physicians
  • 1 member of The Law Society of Alberta or of the judiciary
  • 1 member of the board of an approved hospital
  • 1 member of the College and Association of Registered Nurses of Alberta; and
  • 2 other persons.

HPAB members may be reappointed for up to an additional 3 terms (for a total of 12 years) based on satisfactory performance.
